“When I Die, They’ll Send Me Home”
Over 220 children have been sentenced to die in California’s prisons. The death penalty was found unconstitutional for children by the United States Supreme Court in 2005. Instead, these children have been sentenced to prison for life, with no chance for parole and no chance of release. Their crimes were committed when they were teenagers, yet they will serve the rest of their life in prison. Unbelievably, many of the adults that were codefendants in the crime received lower sentences and will one day be released from prison.
In 2007, Human Rights Watch surveyed children offenders serving life without parole in California. In over 40 percent of cases surveyed, children who had been sentenced to life without parole had not actually committed the murder. One of these cases includes a young child named Jeffery Smith. At age 15, he had been acting as a lookout during a car theft. As the thieves drove away in the stolen car with Jeffery, one adult and two small children were run over as the car flipped over and crashed into a streetlight, killing two others. The two thieves had been given a chance for parole and would be eventually released. Jeffery was put in prison for life. This unequal treatment has affected more than 200 children in California, all put in prisons for life.
